These Terms govern your use of the Clone13 platform. By creating an account or using Clone13, you agree to these Terms.

These Terms are an agreement between you ("you," "your" — the dealership or salesperson using the platform) and Clone13, LLC, an Illinois limited liability company with its principal place of business at 333 N Michigan Avenue #616, Chicago, IL 60601 ("Clone13," "we," "us").
Clone13 provides a platform that lets dealership salespeople generate personal video introductions from a photo and a voice sample, and send those videos — alongside vehicle information — to customers. The service includes dealership and employee management, usage tracking, and per-minute billing.
Dealerships receive an access code and may create employee accounts. Each employee receives a unique access code. You are responsible for keeping access codes confidential and for all activity under your account. Notify us immediately of any unauthorized use.
You agree to use Clone13 only for legitimate dealership sales communication. You agree that you will not:

Clone13 collects a salesperson's photo and voice sample only after that salesperson has signed our AI Likeness, Voice and Video Consent, and only for that salesperson. A salesperson who has not signed cannot use the video Studio at all, so no photo or voice sample of them can be collected. By signing, the salesperson consents to Clone13 collecting and using that biometric information to generate video introductions for their dealership, as described in our Privacy Policy and our Biometric Retention & Destruction Policy. Illinois law (740 ILCS 14) applies.
Under that consent, and under the dealership's own agreement with Clone13, the dealership's managers and BDC (business development center) personnel may write the scripts and generate videos using an eligible salesperson's avatar and cloned voice without asking that salesperson to approve each individual video. That authority covers ordinary dealership-related customer communications only: it does not permit an unrelated endorsement, the attribution of a personal experience, opinion or testimonial the salesperson did not make, or any use of the likeness outside the dealership's permitted business purposes.
Each salesperson signs that consent electronically, in the app, before any photo or voice sample can be collected. No one may sign that consent on another person's behalf. The signed copy is filed in the dealership's Legal Vault, where the dealership and Clone13 can access it.
The dealership is responsible for obtaining and maintaining each salesperson's consent. The dealership must ensure every salesperson it adds has signed before any photo or voice sample is uploaded, must not add a salesperson who has declined to sign, and must not use Clone13 for anyone whose likeness it has no right to use. The dealership must also remove a salesperson from its roster when that person leaves, and must deactivate them immediately if they withdraw consent or object to the use of their biometric information.
Withdrawal and removal are both immediate and both final. From the moment either happens, no further video can be generated from that salesperson's photo or voice model and every video link already shared stops working; the covered data is then permanently destroyed within three business days. Neither can be undone, and a salesperson who returns is added to the roster again as a new salesperson under a fresh consent.
Dealerships are billed a monthly platform fee plus a per-minute rate for generated video, as set by Clone13 per dealership. Billing is calculated based on actual video seconds generated. Invoices are due per the terms presented at signup. We may adjust rates with reasonable notice.
You retain ownership of the photos, voice samples, and scripts you upload. You grant Clone13 a license to process that content solely to generate and deliver your video intros. Clone13 owns the platform, including its software and AI pipeline.
The service is provided "as is" and "as available." We do not guarantee that every generated video will be free of artifacts, or that the service will be uninterrupted or error-free. AI-generated content may occasionally contain imperfections.
To the maximum extent permitted by law, Clone13's total liability for any claim arising from the service is limited to the amount you paid us in the three months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
You may stop using Clone13 at any time. We may suspend or terminate access for violation of these Terms, for nonpayment, or to protect the platform. Upon termination, your right to use the service ends; we will retain data as described in our Privacy Policy.
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-laws principles. The courts located in Cook County, Illinois have exclusive jurisdiction over any dispute arising from these Terms or the service.
We may update these Terms from time to time. Continued use of Clone13 after changes are posted constitutes acceptance of the revised Terms.
Clone13 does not send videos or messages to customers on your behalf — the salesperson, or the dealership personnel who created the video, shares the link themselves. The dealership and its salespeople are solely responsible for how they contact their customers, including complying with the Telephone Consumer Protection Act and carrier requirements for text messages, the CAN-SPAM Act for email, and any state law that applies. Clone13 provides the link; the dealership is responsible for having the right to send it.
