Biometric Retention & Destruction Policy.

This policy explains what biometric information Clone13 collects from dealership salespeople, how long we keep it, and when we destroy it. It is published as required by the Illinois Biometric Information Privacy Act (740 ILCS 14).

1. What we collect

When a salesperson uses Clone13 to create a video introduction, we collect and store:

  • • A portrait photograph the salesperson uploads, used to build a photo-based avatar.
  • • A voice sample the salesperson records or uploads, used to build a cloned voice model.
  • • The resulting voice model and avatar derived from that photo and voice sample.
  • • A record of the salesperson's signed consent, including the typed name, the date and time of signing, and the version of the agreement accepted.

We do not collect fingerprints, retina or iris scans, hand geometry, or DNA. Voice recordings are biometric identifiers under Illinois law; photographs are treated as biometric information by Clone13 as a matter of policy.

2. Why we collect it

Solely to generate personal video introductions for that salesperson's dealership, which the salesperson or the dealership's authorized personnel (its managers and BDC staff) create and send to the dealership's customers. We do not use biometric data to identify anyone, to train general-purpose models, for advertising, or for any product other than Clone13.

3. Written consent before collection

We collect no biometric data until the salesperson has signed our AI Likeness, Voice and Video Consent inside the app. That signature is electronic, is legally binding, and is captured before any photo or voice sample can be uploaded. A salesperson who has not signed cannot use the video Studio at all.

4. How long we keep it

  • • Voice models and portrait photographs: kept only while the salesperson's account is active and their consent is in force. They go out of use the moment the salesperson is deactivated or withdraws consent, and are permanently destroyed within 3 business days of it.
  • • Generated videos: playable for 30 days from creation, after which the video file is deleted from storage. If a salesperson is deactivated or withdraws consent, their videos stop playing at once and the underlying files are permanently destroyed within 3 business days.
  • • Signed consent records: kept as proof that consent was given, and kept after withdrawal so the consent history remains auditable.

5. When and how we destroy it

Two events take a salesperson's biometric data out of use, and both are handled identically. From the moment either happens, no further video can be generated from the salesperson's photo or voice model, and every video link already shared stops working. That disablement is immediate. The permanent destruction of the data then follows within 3 business days. Neither event can be undone: before it is confirmed, the salesperson or their dealership manager is shown a warning that says so, and there is no window in which the destruction can be called off — the few days it takes to complete are not a period in which anything can be restored.

  • • The salesperson withdraws their consent in the app. Their likeness goes out of use at once; their voice model is deleted at our video provider and their stored photos and voice samples are deleted from our storage within 3 business days.
  • • The salesperson leaves the dealership — their dealership manager or a Clone13 administrator removes them. Their likeness goes out of use at once and the same destruction follows within 3 business days.
  • • The dealership account is closed, or Clone13 stops providing the service to that dealership.

Destruction means deletion of the underlying files from our storage and deletion of the voice model at our AI video provider. Disablement is immediate and destruction follows within 3 business days; it does not depend on anyone requesting it, and a scheduled job runs behind it to finish anything that did not complete on the first pass.

Because destruction is final, a salesperson who wants to take part again afterwards cannot simply sign a new consent on the existing record. Their dealership must add them to its roster again as a new salesperson, and they would then sign a fresh consent, record a new voice sample and upload a new photograph.

6. Who can see it

The salesperson, their dealership's managers, and Clone13 administrators. Our AI video provider processes the photo and voice sample under contract solely to generate the requested video. We never sell, lease, rent, or trade biometric data.

7. How to withdraw or ask questions

A salesperson can withdraw their consent at any time from the Assets area of the app, with no penalty and no need to give a reason. They may also ask their dealership manager or Clone13 to withdraw it for them. Withdrawal is final: their biometric data goes out of use at once and is permanently destroyed within 3 business days, and it cannot be undone — the app warns them of that before it goes through.
